About David Burton

David Burton is a lawyer with the firm of Burton & Simkin in Richmond, Indiana, where he practices with his partner, Donald Simkin, and his father, Robert Burton. For 15 years he has represented individuals and families injured by the carelessness of others, including motor vehicle operators, doctors, hospitals, product manufacturers, nursing homes, commercial businesses, and landlords. In the first medical malpractice case he pursued, he obtained a settlement for his client just under Indiana’s damages cap of $1.25 million. Often people who contact him have misgivings about making a claim for their injuries.  Not because they are not hurt.  Not because they were at fault in causing their own injuries.  Rather, they say, "I'm not the sort of person who sues," or "I'm not trying to get rich."  Burton's response reflects his beliefs about his work:   "A lawsuit is not a plea for sympathy or a request to reward you for having been injured. Rather, it’s about fairness.  It’s about trying to return you to the position you were in prior to having been injured.  This is what it means to be compensated, to be made whole.  Anything less is not true justice."
